Each dispute is unique, and this is a guideline only. The exact cost will depend on the individual circumstances of the case and when we know the size and likely complexity of the claim and the amount of work involved, we shall then be able to inform you of the likely cost and also time involved. In claims for more than £25,000 we discuss and prepare a “costs budget” for you so as to comply with court rules.

Each matter is dealt with by an individual fee earner so that you will know who to contact when any queries arise. Our approximate charges are set out below:

 

Debt Recovery

Chris Walker – Consultant Solicitor – £300 + 20% VAT per hour
Cormac Cawley – Associate Solicitor – £250 + 20% VAT per hour

 

Charges

  • Charged in units of 1/10th of an hour – Routine Letters and Routine Telephone Calls (made and received)
  • Fee Earner’s Hourly Rate + VAT Other work on considering and drafting documents, meeting with you, attending experts or counsel, attending court
  • Court Fees Fee to start claim – on a sliding scale up to claims of £9,999, or 5% of value of claim over £10,000, subject to maximum fee of £10,000; other fees are payable in accordance with online Document EX50 of HMCTS
  • Barristers’ & Experts’ Fees Payable in addition to our fees – to be agreed with you in advance
  • £50.00 + 20% VAT – Storage Fee

 

Disbursements

All disbursements will need to be paid in addition to the fees charged. These costs are related to your matter which are payable to third parties such as Court Issue and application fees. We handle the payment of disbursements on your behalf to ensure a smoother process.

 

Timescales

This depends very much on the complexity of each case. A typical disputed matter can take between 6 months and 2 years or more to reach a conclusion.

COURT CLAIMS

These costs apply where your claim is in relation to an unpaid invoice which is not disputed and enforcement action is not needed. If the other party disputes your claim at any point, we will discuss any further work required and provide you with revised advice about costs if necessary, which could be on a fixed fee (e.g. if a one off letter is required), or an hourly rate if more extensive work is needed.

Anyone wishing to proceed with a claim should note that:

  • The 20% VAT element of our fee cannot be reclaimed from your debtor.
  • Interest and compensation may take the debt into a higher banding, with a higher cost.
  • The costs quoted above are not for matters where enforcement action, such as the bailiff, is needed to collect your debt.

Our fee includes:

  • Taking your instructions and reviewing documentation
  • Undertaking appropriate searches
  • Sending a letter before action
  • Receiving payment and sending onto you, or if the debt is not paid, drafting and issuing claim
  • Where no Acknowledgment of Service or Defence is received, applying to the court to enter judgment in default
  • When judgment in default in received, write to the other side to request payment
  • If payment is not received within 14 days, providing you with advice on next steps and likely costs

Matters usually take 4-12 weeks from receipt of instructions from you to receipt of payment from the other side, depending on whether or not it is necessary to issue a claim. This is on the basis that the other side pays promptly on receipt of judgment in default. If enforcement action is needed, the matter will take longer to resolve.
