Each transaction is unique, and this is a guideline only. The exact cost will depend on the individual circumstances of the matter and when we know the size and likely complexity of the estate and the amount of work involved, we shall then be able to inform you of the likely cost and also time involved.

We will normally charge on a time spent basis plus a percentage of the gross estate (usually 1%). Probate costs for an average sized estate can range from minimum £3,000 up to £10,000 + vat + disbursements up to obtaining the grant (excluding any conveyance, sale of shares administration costs and distribution, etc.)

This includes: obtaining the grant, collecting assets and distributing them.

Probate hourly rate

Director/Senior Lawyer/Consultant – £300 + 20% VAT per hour

Junior Lawyer – £250 + 20% VAT per hour

Disbursements (including VAT at 20% where applicable):

  • Probate court fee of £273.
  • £7-£10 Swearing of the oath (per executor).
  • Bankruptcy-only Land Charges Department searches (£3 per beneficiary).
  • £150-£300 Post in The London Gazette – Protects against unexpected claims from unknown creditors. Dependent on the area.
  • £150-£250 Post in a Local Newspaper – This also helps to protect against unexpected claims. Dependent on the area.

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

As part of our fixed fee we will:

  • Provide you with a dedicated and experienced probate solicitor to work on your matter
  • Identify the legally appointed executors or administrators and beneficiaries
  • Accurately identify the type of Probate application you will require
  • Obtain the relevant documents required to make the application
  • Complete the Probate Application and the relevant HMRC forms
  • Draft a legal oath for you to swear
  • Make the application to the Probate Court on your behalf
  • Obtain the Probate and securely send two copies to you
  • Collect and distribute all assets in the estate

Timescales

On average, estates that fall within this range are dealt with within 8-12 months. Typically, obtaining the grant of probate takes 16-20 weeks. Collecting assets then follows, which can take between 4-6 weeks. Once this has been done, we can distribute the assets, which normally takes 2-4 weeks.
