Planning for the Future After a Dementia Diagnosis

Planning for dementia with LPA or Deputyship is an important step after a diagnosis. While this can be an emotional and overwhelming time for you and your loved ones, taking proactive steps now will give you peace of mind and ensure your wishes are respected.

One important aspect to consider is how decisions about your finances, property and care will be managed if you are no longer able to make them yourself. Two key options to explore are Lasting Power of Attorney (LPA) and Deputyship.

To help you make an informed decision, here’s an explanation of these options and how they differ:

What is a Lasting Power of Attorney (LPA)?

An LPA is a legal document that allows you to choose someone you trust (called an Attorney) to make decisions on your behalf if you lose the ability to do so in the future. It empowers you to plan ahead and ensure your preferences are followed.

There are two types of LPAs:

  1. Property and Financial Affairs LPA: Manages your finances, such as paying bills, accessing accounts, and selling property.
  2. Health and Welfare LPA: Covers decisions about your medical care, treatment, and living arrangements.

An LPA must be set up while you still have the capacity to make decisions, so acting sooner rather than later is important.

What is a Deputyship?

A Deputyship is a court-appointed role where someone is given the authority to make decisions on your behalf after you have lost mental capacity. If no LPA has been set up in advance, your family or loved ones will need to apply to the Court of Protection for a Deputyship.

Unlike an LPA, you won’t have control over who is appointed as your Deputy. The court will decide, and in some cases, a professional or Local Authority may take on this role.

Why an LPA is Often a Better Option

  1. Speed
  • LPA: The registration process takes 12–15 weeks, allowing decisions to be made relatively quickly.
  • Deputyship: The process takes at least 12–15 months, delaying important decisions during this time.
  1. Choice of Representative
  • LPA: You can personally choose someone you trust to act on your behalf.
  • Deputyship: The court decides who will act, which could be someone you wouldn’t have chosen yourself.
  1. Scope of Decision-Making
  • LPA: Attorneys can manage both Property & Finances and Health & Welfare, giving you more control.
  • Deputyship: Deputies usually only manage Property & Finances, with Health & Welfare Deputyships being rare.
  1. Supervision
  • LPA: Attorneys operate with trust and minimal oversight, though concerns can be investigated.
  • Deputyship: Deputies are subject to strict supervision, including submitting annual reports to the Office of the Public Guardian, which can be stressful for them.

From Trainee to Solicitor – Minoli’s Inspiring Journey in Family Law at Vyman Solicitors

At Vyman Solicitors, we celebrate the achievements of our team members who embody the core values of our firm. One such success story is Minoli Vehella, a newly qualified solicitor in our Family Law Department. Minoli’s journey from trainee to solicitor showcases her dedication, resilience, and passion for making a real difference in people’s lives.

“I wanted to pursue an area of law that truly made a difference in people’s lives, and Family Law does exactly that,” shares Minoli. Her commitment to delivering tailored, compassionate support has been at the heart of her work since joining Vyman in 2021.

Finding Her Path in Family Law

Minoli’s legal journey began at Cardiff University, where she graduated in 2019. She then completed her LPC at BPP University during the challenges of the COVID-19 pandemic. After gaining initial experience in conveyancing, Minoli realised she wanted to work in an area of law that aligned more closely with her aspirations.

I enjoyed conveyancing, but something felt missing,” she reflects. Family Law ticks all the boxes—it’s dynamic, challenging and ultimately about helping people when they need it most.

Joining Vyman Solicitors through the acquisition of The Sethi Partnership Solicitors, Minoli quickly embraced the complexities of Family Law.

Challenges in Minoli Vehella’s Family Law Journey

Stepping into the Family Department at Vyman, Minoli found herself juggling heavily contested proceedings, often managing cases involving sensitive issues such as child welfare and financial disputes.

Being the only Trainee in the Family Department at one point taught me how to handle high-pressure situations and manage my time effectively,” says Minoli.

She credits these experiences with helping her build essential skills such as prioritisation, clear communication, and adaptability. I learned to communicate effectively with my supervisors to ensure deadlines were met and that I could balance my workload without feeling overwhelmed.

Minoli’s growth was nurtured by the mentorship of senior colleagues like Shreeti Rajdev, whose extensive experience in Family Law provided invaluable guidance.

Shreeti has a wealth of knowledge, and working under her wing has been an invaluable experience,” Minoli shares.

She also gained valuable insights by assisting Zharna Sutaria, Head of the Family Law Department, and other team members. This exposure allowed her to learn various approaches to legal practice and develop her own style.

Minoli has worked on numerous cases that have shaped her understanding of Family Law. From managing complex financial disputes to attending hearings, she has consistently demonstrated her ability to provide practical, client-focused solutions.

I’ve loved attending court hearings and seeing all the hard work we’ve put into a case come to fruition. Watching a client’s relief when their case is resolved is incredibly rewarding, she shares.

Her ability to tailor her advice to each client’s unique needs has been a standout quality. No two cases are the same in Family Law. Learning to adapt my advice and approach has been a valuable skill, she adds.

Advice for Aspiring Solicitors

Minoli encourages those starting their legal careers to choose a field they are passionate about: Pick an area of law you’re passionate about—don’t choose something just for the sake of it. Your enthusiasm for a particular field will shine through and make a real difference.

Looking Ahead

As a newly qualified solicitor, Minoli is excited about the next phase of her career. I’m looking forward to taking on more responsibility, managing cases from start to finish, and continuing to grow in Family Law. Networking and building my profile are also priorities for me, she says.

From Work Experience to Qualified Solicitor – Rhea’s Journey with Vyman Solicitors

At Vyman Solicitors, we’re proud to celebrate the inspiring achievements of our team, including Rhea Dattani’s solicitor journey. From a two-week work experience placement to qualifying as a solicitor, Rhea’s story reflects hard work, growth, and the supportive culture at Vyman.

Rhea Dattani’s Passion for Law and Her Journey at Vyman

Rhea’s interest in problem-solving, learning, and engaging with complex issues led her to pursue a career in law. After completing her law degree at the University of Nottingham in 2020 and her LPC LLM at BPP University in 2021, she joined the Vyman Commercial Team for a short work experience placement.

“I was given incredible opportunities from the very beginning,” Rhea shares. “During my work experience, I was welcomed into the team and trusted to assist on real matters. That short placement led to a Paralegal role, which then grew into a training contract. It’s been a journey of learning and growth that I couldn’t have imagined.”

Early Challenges and Building Confidence

Starting as a Paralegal in the Commercial Team, Rhea quickly took on responsibilities that pushed her to develop professionally. “I was given the opportunity to handle smaller matters on my own and engage directly with clients early on. While it was challenging at first, it gave me invaluable training,” she explains.

Her role required balancing client needs with the practical demands of property transactions. “One of the most important skills I’ve developed is understanding how to align legal advice with a client’s commercial objectives. Working closely with experienced colleagues in the Commercial Team has helped me approach matters with both clarity and confidence.”

Just Walk charity

‘Just Walk’ to raise funds for charity.

147 walkers joined the ‘Just Walk’ to raise funds for charity in the beautiful surroundings of Windsor on Sunday 31st July 2022.  

The walk was organised by the Lions Club of London in conjunction with the Consortium for Street Children and several names Sponsors, including Vyman Solicitors. 

The walkers commenced their walk, in small groups starting from 10:30 am depending on which route they selected, the 14 mile or the 6 miles. The scenic walk took walkers through the beautiful Alexandra Gardens just a stone throws away from Windsor Castle. 12 representatives from Vyman joined with this fund-raising event. Marcella saves the day

We recently received the email below from Henry who wanted to let us know how pleased:
“Dear sir,

I along with six other parents of final year university students, recently engaged Marcella Cox to act for us with regards to a tenancy dispute at their rented accommodation.

The students had rented a property, which once they had moved their belongings into, had turned out to be unfit for habitation. Once this had been brought to the attention of the landlord and estate agent the situation escalated to the point that the landlord was refusing to release them from their tenancy. I sent over some rather patchy correspondence and Marcella set about writing to the agent and landlord. Despite having different points of view from some of the parents on what course of action to take(she had to speak to one separately) she drafted a brilliant letter addressing all the issues. This resulted in the landlord agreeing to release the students from their contract and getting back all their rents paid and deposits. She saw through all the written dialogue between the landlord’s solicitors and kept us in the loop.

As it is their final year, the students were naturally anxious that had this not been concluded so swiftly, it would have impacted their mental wellbeing. Marcella’s swift response to this crisis helped them enormously.

The other parents and I want to place on record our gratitude to this wonderful lady for helping us deal with what was a traumatic situation for both students and parents.

Business Interruption Insurance Claims arising from Covid-19

According to the Association of British Insurers (ABI), insurers in the UK are set to pay out £1.2 billion in claims from individuals and businesses affected by Covid-19 over the coming months.

Of this estimate, the ABI says that around £900 million will cover business interruption claims, £275 million for cancelled travel arrangements, and £25 million for cancelled school trips, weddings and events. Whilst these figures are just estimates, they do make up an official submission to the Treasury Select Committee in order to provide as accurate a picture of the state of the insurance industry as possible at this stage.

The ABI also said, in this blog, that insurers have been managing an extraordinary level of activity over recent weeks, thanks to Covid-19, with some insurers saying that they are dealing with a 200% increase in call volumes.

Huw Evans, director general of the ABI, said:

“This is an unprecedented event, and insurers recognise that it is a very worrying time for everyone.

“While many business owners are uninsured for pandemics, UK insurers still expect to pay over £1.2 billion in claims, making this a significant insured event.

“From paying all valid claims, to providing a range of extra help and support to customers, insurers are working hard to reassure and support policyholders through this uncertain period.

“However, we are also painfully aware that the majority of businesses are uninsured for global pandemics, as is the case throughout continental Europe and North America.

“Although ABI members expect to pay £900 million in business interruption claims, most policyholders are not covered for pandemic losses. We agree strongly that the UK should examine public-private partnerships to find a lasting solution, to enable more affordable, more extensive pandemic insurance cover to be available to those firms who want it.”

Pressure Groups Approach ABI

In response to the ABI, protest group ‘Covid Claims Group’ has written an open letter to the ABI regarding its stance on Business Interruption claims, calling it ‘callous and wrong’. In the letter, founder of the Covid Claims Group, James Ollenshaw, asked insurers to rethink their stance and promise to honour extended business interruption claims with regards to the coronavirus.

Mr. Ollerenshaw wrote:

“The ABI’s abrogation of responsibility has come as a considerable shock to SMEs that paid extra for extended business interruption (BI) cover.”

The letter goes on to say that whilst they did not expect businesses with basic business interruption insurances to be covered for the Covid-19 situation, they are aghast that pay-outs are been refused where policy holders have paid a premium for a level of cover that they believed would protect them against any forced closure of their business.

Insurers including Hiscox, RSA, QBE and Allianz have all come under fire for their refusal to pay out on business interruption claims, seemingly backed up by the ABI’s public position on such claims.

As of Monday 11 May the letter had 666 signatories.

Why Are Businesses Struggling to Claim?

Each insurance policy is different and, even if policies do have the extensions outlined above, there may be certain exclusions which insurers may seek to rely upon; or insurers may argue that the novel COVID 19 pandemic is simply not covered.

Another point to note is that business interruption policies often require the outbreak to be specifically at the business premises or within a certain area surrounding the premises. Certain insurers are relying on this to avoid cover.

How Can You Make A Claim?

If you wish to make a claim on your insurance for anything related to coronavirus, it is useful for you to follow certain steps to make it more likely that your claim will be successful.

  1. Look over your insurance policy in fine detail to see if your situation is covered.
  2. If you do believe that you are eligible to make a claim, build your case carefully, gathering any documents and evidence that you can to make your case stronger. These could include documents that prove your earnings, and any documentation that evidence the damage done to your business.
  3. Follow the claims procedure specified in your policy documents. Failure to follow the procedure may jeopardise your claim.

What If Your Insurer Declines Your Claim?

  1. You could make a formal claim against your insurer which may involve instructing solicitors and ultimately commencing court proceedings.
  2. You could also investigate whether you have a claim against your broker for failing to advise you properly.
  3. Financial Ombudsman Scheme. You could make a claim under this scheme, which is limited to £350,000 per claim. This could be a quicker and cheaper alternative to suing your insurer or broker in court.
